The key question put to the vote is whether or not self-employed drivers should be included in the scope of the directive.  Having it on the agenda would not be in agreement with the need to have one month time between the vote of the Committee and Plenary.

ESC agrees with the Commission proposal, which was rejected by the European Parliament Employment Committee, to exclude self-employed drivers.  ESC believes that self-employed workers should have the freedom to organise their work according to their specific requirements. Any limitations in the freedom to organise their working time and the resulting possibility to earn extra income could be detrimental to the competitiveness of this sector. It could also have a negative impact on the shortage of drivers.

All drivers, including self-employed drives - irrespective of employment status - are covered by Regulation 561/2006 regulation on the harmonisation of certain social legislation relating to road transport (which covers self employed and employed - EU rules on driving times and rest periods).
